Delays of payment, unpaid debts, unpaid fines … When a person does not reimburse what they should, their creditors can obtain authorization to take directly from their bank account. This forced execution procedure is called attachment to attribution, which is generally carried out after court decision, at the initiative of a bailiff or a public organization such as the Treasury or the CAF. Once the prescription has been validated, the bank is required to block the funds available on the account, without the person concerned having a say.
But the law provides for a safeguard: whatever the debt, a minimum sum must necessarily remain available on the account. It is supposed to allow the person seized to provide for their essential needs (feeding, moving, treating themselves …). This safety net applies automatically, without a process to be done, as soon as a entry is launched. It guarantees a vital minimum, identical for everyone, regardless of income or the family situation.
It is the elusive banking balance (SBI), aligned with the amount of the RSA for a single person without children. Since April 1, 2025, it amounts to 646.52 euros. As long as the account balance remains below this amount, no entry is therefore possible. If the account displays a higher amount, only the excess party can be entered. But the SBI only applies once, even if the person has several accounts or is the subject of several seizures.
When the banking balance exceeds 646.52 euros, the entry can relate to anything that exceeds this threshold, within the limits of the sum required. If you have 900 euros on your account, only 253.48 euros can then be taken.
In case of difficulty, it is recommended to carefully monitor your statements and react quickly in the event of an anomaly. If the SBI has not been respected, the bank must restore the situation without delay. It is also possible to seize the execution judge to contest an abusive seizure or request payment deadlines.
