Among the (small) hassles of the life of owner owner, the refrigerator which breaks down is a great classic. Fabien has just received a phone call from his tenant, who asks him to replace the fridge his two furnished two rooms, which he has occupied for almost a year. “Is it up to him or me to pay the bill?”asks Fabien, in the program Le Grand Rendez-vous de l’Emal du Real estate (Capital/Radio Immo). Insofar as it is a furnished accommodation, and not a bare rental, large is the temptation to respond to Fabien that it is up to him, the owner, to pay the price of the new refrigerator.
Not so fast! Two decrees Break this type of situation, recalls Jérémy Sourice, real estate representative at IAD. First, that of August 26, 1987, taken in application of the 1986 law relating to rental repairs. This text indicates that “Current maintenance and small apparatus repairs such as refrigerators” are the responsibility of the tenant. Then, the decree of July 31, 2015, fixing the list of furniture which must be present in a furnished accommodation. Furniture that “The owner must replace in case of obsolescence”indicates Jérémy Sourice.

To find out who, from Fabien or his tenant, must pay the new refrigerator, it is therefore a question of determining if the failure comes from the obsolete of the device or a lack of maintenance by the tenant. “A fridge must be changed every ten years approximately”underlines Jérémy Sourice. Even if that of Fabien’s T2 would be more recent, the real estate agent advises him to “Doing yourself violence and replacing it, in order to keep your tenant”. Nothing is more painful than the tenants’ turnover and the rental vacancy, for an owner!
