It is a reality, every month, many French people struggle to pay their mortgage or consumer credit. Dismissal, illness, drop in income: life accidents can quickly transform their financial situation into a nightmare. However, many borrowers are unaware that a legal device allows them to temporarily suspend their reimbursements without undergoing penalties.
When financial difficulties settle down, several solutions exist before considering over -indebtedness. Negotiation with the bank, use of borrower insurance … but there is a particularly advantageous and unknown mechanism: the “Grace deadline”. The court can grant this suspension “Especially when you have suffered a dismissal”but other temporary difficulties situations can justify the request. The lawyer highlights a major advantage: “What is interesting to underline is that at the end of this grace period, the borrower will not have to reimburse the unpaid deadlines. Indeed, the duration of the credit will be extended all the way.”
To benefit from this period of grace, it is necessary to seize the judge of the litigation of the protection of the judicial court of his place of residence. As the lawyer specifies, “It is enough for the borrower to justify his difficulties, such as a dismissal.” The file must contain documents proving financial difficulties: supporting resources, expenses and reimbursements in progress. Unlike negotiations with the bank, the judge has a decision -making power imposed on the lending establishment.
