25 years after its creation, the PACS is still as popular. According to the latest INSEE statistics, 204,000 civilian solidarity pacts were signed in 2023, almost as much as the number of weddings (242,000). But many PACS partners ignore it: beyond certain tax advantages, including the common income declaration which may reduce the amount of couples tax with real wage differences, this contract is much less protective than marriage.
Among the advantages of which they are deprived: the absence of inheritance despite a inheritance tax exemption – Except for partners who have planned a will – and survivor’s pension. Namely part of the retirement of the member of the deceased couple. A right for married spouses, not for PACS couples. A “Inequality (which) generates a concrete injustice”explains a bill (PPL) tabled in the National Assembly on September 16, 2025 by the LR deputy of Aisne Julien Dive, and co -signed by around thirty elected officials of all stripes (republican right, together for the Republic, democrats, socialists and related, Horizons & Independent, Democratic and Republican left).
The pension orientation council favorable to enlargement to PACS couples
For Julien Dive, the reversion pension “Is a conjugal solidarity mechanism, based on obviousness: after having crossed life together, it is not just that the survivor finds himself alone … and without anything!” And this is what awaits PACS’s partner on the death of his half. “A PACS partner, even after 20 or 30 years of common life, is not entitled to any survivor’s pensionhe denounces. Women and men, who shared a life, who contributed, accompanied their spouse in the disease, raised their children, find themselves overnight without any rights, simply because they were not married. “
It is not the first attempt of the elected official of the Aisne who had already deposited a PPL in this sense in 2019, before a new bill presented in 2023 by Danielle Brulebois (Renaissance) asked to extend this right to the partners of a civil solidarity pact of a minimum duration of five years in September 2023. Without success. But while the pension orientation council (COR) spoke in 2024 for the extension of the survivor’s pension “To the PACS (whose obligations have increased over time), or even possibly to cohabitation”Julien Dive’s bill could find an echo more favorable to Parliament.
