The President of the Republic Sergio Mattarella (Ansa)
He made a sensation and opened a heated debate also in the newspapers the case of Gabriele Finotello that on February 22, 2021 killed his father Giovanni in their home in their home Porto Viro (Rovigo) and was sentenced to 9 years and 4 months of imprisonment. His case has returned to the limelight because Finotello, today 34 years old, is one of the four people to whom the President of the Republic Row gradually granted grace, deleting the penalties to which they had been condemned completely or partially.
The power to grant grace and commuting the penalties is conferred on the President of the Republic from article 87 of the Constitution: Mattarella, who took office in 2015, had so far signed 35 measures of grace for as many people, the last time in 2021. In the note of the Quirinale it is explained: «In granting the grace that extinct the entire residual sentence to be expiated (equal to 4 years and 3 months of imprisonment) The Head of State took into account the favorable opinions, formulated by the Prosecutor General and by the surveillance magistrate, the health conditions of the condemned and the particular context in which the criminal episode matured, characterized by repeated acts of violence and threat from the victim towards his family “.
The murder carried out by Farm matured in a very particular family context. The father, in fact, had serious problems of dependence on alcohol and this, in the past he would have led him to violent behavior towards his wife and two children. Precisely for this reason, his wife and younger son had gone home. Gabriele, on the other hand, who had also recently found a new job as OSS (Social-health operator) to Polesi Institutes of Ficarolo (Rovigo), He had continued to live with his father, also because he wanted to follow him on a path of care of this dependence. For this reason, every day, he did up and down from Ficarolo to the home of Porto Viro, along, between return, about 150 kilometers.
And for this, when that afternoon of February 22 he found himself in front of his father, at that moment unemployed, attached to a bottle and completely drunk, he scolded him heavily. “But stop drinking, look at how you reduced yourself”: it was the phrase that would have turned on the quarrel passed from words to the hands. The father would have fallen to the ground and, getting up, would have said the phrase that unleashed the reaction of the son: “Leave me alone or beware of you as I beat your mother.”
It is at this moment that the thirty -year -old hands grabbed the hammer with which he launched the mortal shots. At least four, to the bust and head. The young man, immediately after realizing he had seriously injured his father, not only did he not try to escape, nor did he try to hide the evidence of what happened, but immediately called 118 for the father to be rescued and then, after telephoning the mother to tell her what he had done, he also called the carabinieri.
Since the first interrogations, Farcatello has always shown himself collaborative by helping investigators to reconstruct the family context of the crime in detail.
At first instance, on May 13, 2022, he had been sentenced to 14 years, also because mental semi -firmness had been recognized at the time of the fact, as evidenced also by the expertise that had been entrusted to a forensic psychiatrist by the college. On appeal, the sentence was then further reduced. And now, for him, the grace of the President of the Republic.
Who are the other people grazed by the Head of State
The other person grazed by Mattarella is Massimo Zen, A former security guard. In April 2017 he killed the carousel Manuel Major with some gunshots while he ran away, together with two accomplices, after having made a theft to an ATM in the province of Treviso. For this murder, Zen sentenced to nine years and six months in prison for voluntary murder and for illegal communication cognition, a crime that punishes those who come aware of conversations without having authorization. Also in this case Mattarella granted partial grace, extinguishing three years and three months, taking into account the health conditions of Zen and the fact that he had compensated the family of the killed person. As a result of the Zen provision, a maximum sentence of four years remains to be served, and may request the assignment of social services.
Less known to the general public are the cases of Patrizia Attinà and Anchuta Stimbu. The first, born in 1972, had been sentenced to a total sentence of two years, eight months and twenty days in prison for theft and extortion crimes dating back to the period between 2012 and 2016. Mattarella totally extinguished the residual sentence, citing the time that passed by the completion of the crimes as motivations, the forgiveness granted by the offended person of the most serious crime and the living and health conditions of the woman. Stimbu was born in 1986 and had been sentenced to nine years, seven months and seventeen days in prison for extortion and crimes in the field of drugs. Mattarella granted her partial grace, extinguishing a year and six months of the sentence that still had to serve: the press release says that on the decision they influenced both the context in which the crimes were committed, and the family conditions of Stimbu, and the fact and before the definitive sentence themselves, serving the penalty in reliance in proof of social services “profitablely”.
