As soon as promulgated, as soon as applied. Certain provisions of the law “aimed at strengthening the regulatory tools for furnished tourist accommodation on a local scale”promulgated on November 19, will come into force in Paris from January 1, 2025announced the town hall on November 28. In addition to less advantageous taxation, this so-called “anti-Airbnb” law offers mayors new tools to fight against the illegal rental of furnished tourist accommodation. A crucial struggle in the capital, where finding a long-term rental is often an obstacle course, as rentals of furnished tourist accommodation, more profitable and less restrictive, have multiplied in recent years.
Concretely, in Paris, from January 1, you will no longer be able to rent your main residence to tourists only 90 days per year maximumcompared to 120 today. The “Le Meur-Echaniz” law, named after the deputies who introduced it, authorizes all municipalities, from next year, to limit the maximum duration of rental of main residences to three months per year. tourists. If you do not respect this new 90-day limit, you risk a civil fine of 15,000 euros.

A fine doubled to 100,000 euros
Still in terms of fines, the city of Paris will toughen those punishing illegal transformation of use, which will be doubled, to 100,000 euros. Renting, repeatedly for short periods, to a passing clientele, furnished accommodation which initially serves as a home, in fact constitutes, under French law, a “change of use”. In certain municipalities, such as Paris, prior authorization from the mayor is necessary before you can change the use of your accommodation to furnished tourist accommodation. This regime was introduced in order not to dry up the long-term rental market. Jacques Baudrier, deputy mayor of Paris in charge of housing, believes that 25,000 furnished tourist accommodations are rented illegally in the capital. Other fines will target furnished tourist rental platforms, such as Airbnb and Abritel, which do not fulfill the obligation to remove advertisements that do not respect the ceiling on the number of nights, or concierge services which visit “accomplices” of a fraudulent rental.
“We do not expect this proposed regulation to have a significant impact on our business”reacted Airbnb, while “regretting these new diversionary measures, which will not resolve housing problems, and continue to omit the real issues linked to the concentration of tourism in the center of Paris”. “In cities that have implemented drastic measures of this type, such as New York, no positive impact on the long-term rental market is not observed”insists Airbnb.
