In this text, deposited at the office of the National Assembly this month, the parliamentarian estimates that “”The entire functioning of the public service is threatened»» by the difficulties of his workers in lodging. It therefore offers a first reform, to increase the number of social housing for public officials. Today, public officials tenants of an HLM benefit from the right to keeping in the premises, law attached to social housing, whatever their professional development. Thus, caregivers from a hospital who are assigned an HLM because their employer has booking rights to the social landlord can keep it if they leave the public hospital service. The hospital will therefore not be able to have this HLM to house the agents it will have to recruit to replace them.
An article in the Construction and Housing Code certainly provides that “Officials and state agents, civilians and soldiers, awarded social housing, only benefit from the maintenance in the premises in the event of transfer, cessation of services or deaths for six months”. But this article “East limited to the State Civil Service»»underlines David Amiel, who suggests extending it to the hospital public service, the territorial public service and to public enterprises.

Another proposal from the deputy to increase the supply of social housing for public officials, the acquisition of additional booking rights by a public administration if it brings land to an HLM construction program. Currently, when an administration gives way to a social landlord, with a discount, with a view to building HLM, it can only benefit from 10%at most, social housing of the program for its staff. David Amiel wishes carry this proportion to 50%, even 70%.
The deputy also intends to allow customs services and prison administration to choose precisely the places in which they wish to reserve social housing for their staff. Such an exception already exists for housing reserved by national defense services, health and internal safety establishments. It is due to the specifics of the activity of these agents, who cannot be housed in any neighborhood, at the risk, if not, to compromise their security.

A law that would complete local initiatives
Always to increase the supply of housing for public officials, the deputy intends to simplify their construction in the local urban plans (PLU). Today, when a public administration has land or a building which it considers oversized, “its Conversion into housing is often made impossible by local urban planning plans »regrets David Amiel. Which therefore proposes to give a possibility of derogating from the PLUs to the administrations wishing to convert or build housing for their agents on part of their land.
It remains to be seen when this bill can be examined by Parliament. In any case, it follows from a report on the housing of public services of public services submitted a year ago by the same David Amiel to the government, at the request of the latter, who wanted to develop a “Real interdepartmental policy of access to housing for public officials”. Which would usefully complete local initiativesas the acquisition, announced in 2023, of more than 1,000 housing booking rights by the AP-HP (Public Assistance-Hospitals of Paris) to social landlords and residences of young workers, thanks to financial support of 21 million euros emanating from the regional health agency Ile-de-France.
