Lessor owner of housing labeled G on the energy performance diagnosis (DPE), you cross your fingers that your tenant does not give you notice in the coming months. The rental of G thermal strainers will in fact be prohibited from January 1, 2025, for leases concluded from this date. At the risk of finding yourself illegal the day your tenant decides to leave, it is better to undertake energy renovation work to improve the rating of your property on the DPE. Which requires using the services of a real estate diagnosticianthe professional best able to tell you what work could raise the accommodation to a D rating, for example.
The problem is that you don’t know any diagnosticians. By searching the internet, you will find plenty of them, but how do you know what they are worth? Two years ago, a UFC-Que Choisir survey had highlighted “of the notes and recommended work sometimes with variable geometry»with 6 out of 7 houses which had not been recognized as having the same energy class by the various diagnosticians called upon by the association.

Cases of identity theft of real estate assessors
“Energy renovation is a breeding ground for fraudulent activities. The financial intelligence service Tracfin recently highlighted a worrying situation, marked by an intensification of fraud linked to public aid schemes, in particular MaPrimeRénov’. These frauds manifest themselves in various forms, such as identity theft of diagnosticians.worries about Capital MP Daniel Labaronne (Together for the Republic).
“Today, there is no secure, reliable database allowing owners to identify diagnosticians authorized to practice this profession of so-called professionals. Which can cause difficulty people who nevertheless pay very dearly for these diagnoses»he continues. Paying between 100 and 250 euros to be told that your property is rated E when it is in reality G, and thus risk finding yourself outside the law by continuing to rent it after January 1, 2025, is It’s indeed a bit stiff.

A database to detect fraudulent diagnosticians
Daniel Labaronne therefore proposes the creation, by the State, of“a single, centralized database allowing the consultation of real estate diagnosticians working in the field of DPE, in order to ensure the transparency and accessibility of information to all owners, tenants and buyers”. Any diagnostician, whether in activity, suspended or deregistered by his certification body, must be registered in this database, “in a secure format based on traceability technologies”to allow landlords to “detect possible fraudulent diagnosticians”, develops the deputy.
The creation of this database is the subject of an amendment that Daniel Labaronne will make as part of the examination of the bill. (PPL) «against all public aid fraud“, filed by his colleague Thomas Cazenave (Together for the Republic), former Minister of Public Accounts, at the office of the National Assembly on October 15. This database would complement thedecree of July 20, 2023which defines the certification criteria for diagnosticians and the requirements with which their training organizations must comply.
