The law is very clear on this point: offenders will even have to pay fees to recover their vehicle. Even worse if they oppose it!
Having a car is very practical. But having your own parking space is even better. This avoids going around in circles for long minutes, especially when you get home from work or during rush hours, when the streets are full and the places rare. The problem is that even the reserved locations are not always respected. Sometimes other cars park there without authorization, especially when the place is not boxable, whether outdoors or in covered parking. And when you are the owner or tenant of the place, it is particularly annoying not to be able to park at home, when we pay for that.
A situation that many motorists know … But what to do to recover your place? The law is quite clear on the subject: there are appeals, provided that you follow certain steps. The first is rather courteous, it is a question of leaving a polished word on the windshield of the vehicle parked illegally. If, despite everything, the owner does not react and continues to occupy the place, it is time to envisage another solution, namely to have the car removed. To do this, it must be proven that the motorist uses your place repeatedly. Take photos, note the dates, hours and duration of parking each time.
If it is a person in your residence or a perfect unknown, there is in any case a period to be observed, which is eight days to have the vehicle removed by the police. Once this period has passed, the procedures depend on the identity of the driver on fault. As article L325-12 indicates: “May at the request of the master of the premises and under his responsibility, be put on impoundes, alienated and possibly delivered to destruction the vehicles left, without right, in public or private places where the highway code does not apply.”
When a car embarrassments in a residence, the syndicate of condominiums must be warned. If the owner is identified and the situation does not move, the union then initiates a procedure: he sends him a formal notice to release the place, then seizes the police. On the other hand, if the owner remains unknown, it is a judicial police officer who can order the removal after checking that the vehicle is not stolen. Once the vehicle is in pounds, the owner will have to pay the costs if he wants to recover it!
