Bad news for future buyers. THE transfer duties for consideration (DMTO), More commonly known as notary fees, could increase in many departments in the coming months. The 2025 finance law, promulgated on February 14, authorizes the departments to note the DMTO ceiling of 0.5 point from April 1, 2025, until April 30, 2028. This measure aims to compensate for the Cup From 2.2 billion euros imposed by the State on local authorities, provided for in the 2025 budget.
Concretely, this temporary increase in notary fees will have to be the subject of deliberations, department by department. It is indeed the departmental councils which will be responsible for voting, or not, this famous increase in DMTOs. The city of Paris, which has departmental jurisdiction, took the lead by being the first department to vote on Tuesday, February 11, the increase in DMTOs of 0.5 point. The measure will come into force on April 1, 2025.
With regard to other departments, the date of entry into force of a possible increase in notary fees will depend on the period at which the departmental councils will vote. Note that the rate applicable to transactions is that in force at the time of the sale (the signing of a promise prior to the increase in rights therefore does not allow the old rate).
An “essential” measure for the departments
We invite you to discover in our table the dates of entry into force of a possible increase in notary fees of 0.5 point depending on the period during which the departmental councils will vote the measure. For example, if the date of deliberation is set before February 28, 2025, the increase in notary fees will be effective on April 1, 2025. If your department votes the increase in DMTOs between March 1 and March 31, 2025, the Increase in notary fees will be effective for buyers from May 1, 2025. and so on.
Unfortunately for future buyers, many of them should approve this increase in notary fees of 0.5 point, which corresponds to a In addition to around 1,500 euros for a property at 300,000 euros. The UDI President of the Association of France Departments, François Sauvadet, said on France Info on Wednesday, February 12, that the increase in DMTOs “Has become essential and (that) all the departments will do it”. If you plan to buy real estate, it is therefore advisable to carry out the transaction as quickly as possible, in order to escape this possible increase in taxes.
