Considering “Abandoned by a system however supposed to protect the owners as much as the tenants”, Roman had held to “Alert to a ordeal that can happen to any lessor»»in testifying with Capital Last March. This ordeal is that of unpaid rentagainst which the Corentin Le Fur deputy (republican right, Côtes-d’Armor) hears “Defend the owners”via a bill (PPL) co -signed by 19 other parliamentarians from his party, and deposited in the National Assembly this Wednesday, September 30.

“Too many owners find themselves today trapped “ Rent unpaiddeplores Corentin Le Fur in the presentation of the reasons for his PPL. “In the absence of a sufficiently protective legal framework, they become the Victims of bad payable tenants who take advantage of the administrative slowness and the complexity of the legislation so as not to honor their rents ”he denounces. However, rental investment is “Mostly the work of households of the middle classwhich invest in stone to have a supplement of retirement income, not speculators “assures the deputy.

His rental investment turns into a nightmare: 5,000 euros in unpaid and a threatening tenant

The unpaid rent, a cost of several thousand euros

Many of these landlord owners therefore find themselves in financial difficulty when they no longer perceive the rents making it possible to reimburse the credit monthly payment and pay the co -ownership charges, as well as the property tax. Without forgetting the Cost of repairssome accommodation being returned “In a deplorable state after months, even years, of free occupation”denounces Corentin Le Fur.

Are also added the legal costs of “Long and costly procedures” To try to recover the property, underlines the parliamentarian, citing a total cost of “Several thousand and, sometimes, several tens of thousands, euros”. Our Roman witness, who no longer received his 950 euros of monthly rents since March 2024, had made his calculations: if his tenant ended up being expelled in March 2026, he would have lost nearly 25,000 euros In total, between rent unpaids, bailiff fees and lawyer fees.

Sometimes several years to expel a tenant who no longer pays

“For fear of bad payers, many owners give up long -term rental, which helps reduce rental supply and worse the housing crisis»»points the deputy. In order to “Restore the balance between donors and tenants”his bill aims to accelerate the expulsion procedure in the event of rent unpaid. “Our compatriots do not understand that it is sometimes several years to expel an occupant who does not pay”argues Corentin le Fur.

First, the PPL modifies article 24 of the law of July 6, 1989 tending to improve rental reports, in order to twofrom six to three weeks, the delay left to the tenant to regularize his debt. She then specifies that the granting of deadlines by the judge is only possible in the event of good faith of the tenant, proven for example by his determination to regain payment of the rent once his difficulties have been surmounted. Furthermore, the bill completes the code of civil execution procedures by creating a specific procedure before the Protection Litigation Judge, which will have to rule within a period of 30 days on an expulsion request.

“My ordeal of owner in front of a tenant who no longer pays the rent”

Get the competition for the public force faster

Finally, the PPL modifies article L. 153-1 of the Code of civil execution procedures, to impose on the State to rule within one month on any request for Public force competition to make the expulsions. These “Remain too slow, too uncertain, and intervene too late for lack of rapid competition of the public force”believes Corentin le Fur. It remains to be seen when his bill can be examined by the Parliament, in the current political context, the new Prime Minister Sébastien Lecornu still not having appointed his government.
