Each month, the “big savings meeting” (capital / radio heritage) answers your questions in the “your questions, our answers” sequence. Our experts – notaries, taxpiens, heritage advisers – accompany you on all your money questions. Today, we respond to Agnes, who wishes to find the notary who took care of the succession of her father, who died in 1990. She fears a potential spoliation, but does not know where to start her research.
Finding a notary has been easier since 2007
The main obstacle turns out to be the age of succession. “Since 2007, notaries must include on the sidelines of the deed of death the mention of the act of notoriety, which makes it possible to easily find the study in charge of the file”explains Thomas Prud’homoz, associated notary at KL-Consign. This was not yet the case at the time of the death of the father of the auditor in 1990. For older successions, it is therefore necessary “Operating by harness of clues”, advises the notary.
First question to ask: did the deceased have real estate? If yes, it is possible to seek a certificate of property, which would have been established by a notary. Another track: consult the central file of the latest wishes (FCDDV) provisions, which centralizes the wills deposited at the notaries. “There is a good chance that the will has been entrusted to the family notary, to which we were often faithful at the time”continues Thomas Prud’homoz. We can also search for this notary – or his successor – via the official directory of the notaries of France.
What if the notarial study has closed in the meantime? Don’t worry: “The minutes of a notary-that is to say his actions-are always entrusted to another study. Even in the event of bankruptcy or retirement, the files do not disappear ”recalls our guest.
