“The heirs sometimes do not understand why they do not benefit from the same invoicing advantages as the deceased.” And yet, as the mediator of the Authority for Financial Markets (AMF) recalls in his logbook published on May 5, 2025, the advantageous conditions sometimes granted to a customer are simply not transmitted. These conventions “Being intuited personae, that is to say concluded in consideration of the person, they necessarily end the death of the customer”warns Marielle Cohen-Branche.
In the file taken as an example by the mediator, a brother and a sister had asked, following the death of their mother, the sale of the actions appearing on his secure. An order, sent by the notary by mail to the deceased bank, which then causes a brokerage committee. However, the costs levied by the financial institution are much higher than those that their mother would have paid during her lifetime. Very superior, therefore, but also completely justified, according to the mediator of the AMF, seized by the heirs.
A “new contractual relationship” on behalf of succession
Two reasons justify the amount of billed. First of all, the heirs having made their request by mail, “The claimed pricing was not applicable, because the order of sale of securities had not been transmitted via one of the channels which benefit from this specific pricing: Internet, Mobile or Telephone”specifies the mediator of the AMF. And this, even if the notary who passed the order of sale did not have access to the mobile application and that, by his function, he could not make the request by phone.
Above all, and this is the main lesson in this file: the specific tariff conditions possibly granted to the customer of a bank “Take an end when the latter dies”. So, afteropening of a successionthe account dedicated to its payment “Is subject to a new contractual relationship, only governed by the general conditions of bank applicable to the inheritance joint ownership accounts which must then be opened upon notification of death”. The pricing advantages therefore disappear well with the deceased.
